1. Eligibility and accounts

By using the Service, you represent and warrant that you satisfy the minimum-age requirement, have legal capacity to accept these Terms, have not previously been suspended or removed unless we authorized your return, and will comply with applicable law. If you use the Service for an organization, you represent that you may bind it to these Terms.

You are responsible for the security of your NanoGPT account and credentials and for activity under your account. Contact contact@nano-gpt.com promptly if you believe your account has been compromised.

2. The Service

SillyNano provides AI roleplay chat and tools to discover, create, and share fictional characters. Characters are user-created fiction. A character's description, statements, and generated responses do not represent the views of the operator or any real person, even when fiction resembles real people or events.

AI output is probabilistic fiction and may be incomplete, incorrect, offensive, or otherwise unsuitable. It may not be unique, and other users may receive similar output. Do not rely on output as a source of fact or professional advice, or use it to make legal, medical, financial, employment, housing, or other material decisions about a person. You are responsible for reviewing output before using or sharing it.

Models and other parts of the Service may be supplied by third parties and may change, become unavailable, or be subject to additional provider terms. We may modify or discontinue features as the Service develops.

3. User content and conduct

Prompts, messages, character cards, names, descriptions, avatars, personas, and other material you provide are "Input"; responses generated from Input are "Output." Together they are "Content." You are responsible for your Content and how you create, use, publish, or distribute it. You represent that you have every right, permission, and valid consent needed for your Input and intended use.

You may not use the Service to:

• Infringe, misappropriate, or violate copyright, trademark, privacy, publicity, likeness, voice, biometric, personal, or other rights.
• Create, upload, request, facilitate, possess, or distribute child sexual abuse material or any sexual or exploitative content involving a person under 18 or a person depicted as or reasonably appearing to be under 18, whether real or synthetic.
• Create, upload, request, or distribute nude, intimate, or sexually explicit content depicting an identifiable person without that person's valid consent, including non-consensual intimate imagery or sexually explicit deepfakes.
• Use another person's image, likeness, voice, personal information, or identifying material without all rights and consents required for the Input and intended use.
• Impersonate a person or distribute deceptive synthetic media in a manner likely to defraud, harass, defame, exploit, or materially harm someone, or omit disclosures about altered media when the law requires them.
• Facilitate human trafficking, sexual exploitation, stalking, doxxing, credible threats, unlawful discrimination, fraud, or other unlawful conduct.
• Interfere with the Service, bypass access controls, rate limits, safety mitigations, or protective measures, or programmatically extract data in circumvention of them.
• Reverse engineer or attempt to discover non-public source code or underlying components of the Service, except to the extent applicable law prohibits this restriction.
• Represent AI-generated Output as human-generated when doing so would be deceptive.

4. Content rights and intellectual property

As between you and the operator, and to the extent permitted by law, you retain ownership of your Input and own Output. We assign to you any right, title, and interest we may have in Output. This does not give you rights in third-party material or override applicable law or model-provider terms.

You grant the operator a non-exclusive, worldwide, royalty-free license to host, reproduce, transmit, format, store, display, and otherwise process Content only as needed to provide, secure, moderate, troubleshoot, and improve the Service; operate sharing or sync features you enable; enforce these Terms; and comply with law. Public characters and avatars may be displayed to other users. The operator and its affiliates retain all rights in the Service, software, branding, and other operator materials.

Copyright complaints and DMCA notices

If material available through the Service infringes your copyright, send a written takedown notice to the operator's designated copyright agent at contact@nano-gpt.com. The notice must include:

• Your physical or electronic signature.
• Identification of the copyrighted work, or a representative list of works.
• Identification of the allegedly infringing material and enough information to locate it, including the relevant URL where available.
• Your name, mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the disputed use is not authorized by the owner, its agent, or the law.
• A statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

A user who believes content was removed by mistake may send a legally compliant counter-notice to the same address. We may share notices and counter-notices with the affected parties and restore material as permitted by law. In appropriate circumstances, we terminate or disable the accounts of repeat infringers. We may also restrict or terminate access for a single serious infringement.

5. Moderation and enforcement

We may use automated systems and human review to moderate characters, avatars, and other Content. We may refuse or restrict requests, investigate suspected violations, remove or disable Content, limit visibility, preserve relevant information, and suspend or terminate access to protect users, third parties, providers, or the Service, or to comply with law. We do not undertake a general obligation to monitor all Content.

We may report apparent illegal material or conduct and disclose information when we reasonably believe disclosure is required by law, valid legal process, protection of rights or safety, or enforcement of these Terms. To appeal an enforcement decision, contact contact@nano-gpt.com.

6. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if your use could create risk or harm for the operator, providers, users, or anyone else. Provisions that by their nature should survive termination will survive, including provisions about Content, intellectual property, disclaimers, liability limits, and general legal terms.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS." EXCEPT TO THE EXTENT PROHIBITED BY LAW, THE OPERATOR, ITS AFFILIATES, AND LICENSORS DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL NOT BE LOST OR ALTERED. USE OF AI OUTPUT IS AT YOUR SOLE RISK.

8. Limitation of liability

NEITHER THE OPERATOR NOR ITS AFFILIATES OR LICENSORS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, USE, OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY. AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE LIABILITY AROSE OR ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Some jurisdictions do not allow certain warranty disclaimers or damage limitations. In those jurisdictions, these Terms limit responsibility only to the maximum extent allowed, and you may have additional non-waivable rights.

9. Governing law and general terms

Except where the mandatory law of your residence requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any permitted court proceeding must be brought in a state or federal court located in San Francisco, California, except that a consumer may bring a qualifying small-claims action or any claim that applicable law permits or requires in the consumer's local courts.

We may update these Terms as the Service, law, safety needs, or technology changes. We will post revisions here and update the date above. If a change materially affects account holders' rights or obligations, we will provide advance notice where required. Continued use after updated Terms take effect constitutes acceptance; otherwise, stop using the Service.

If a provision is unenforceable, it will be enforced to the maximum permissible extent and the remaining provisions stay effective. Failure to enforce a provision is not a waiver.
